Terms of Service

§1. Definitions

1. Service – a web application available at https://www.probelist.com, enabling the creation and management of workspaces, objects, and inspection items.
2. User – a natural or legal person who uses the Service after accepting these Terms of Service.
3. Account – the User's individual panel in the Service, enabling the use of its functionalities.
4. Inspection Data – any data, reports, photos, locations, and other information entered by the User within the Service.
5. Weban – the owner of the Service, Weban Artur Kremens, based in Świdnica, ul. Mieszka I 4a, 66-008 Świdnica, Poland, NIP: 9730871143.

§2. Registration and Use of the Service

1. Use of the Service requires account registration and acceptance of these Terms of Service.
2. The User agrees to use the Service in accordance with the law, good practices, and the provisions of these Terms.
3. Minors may use the Service only with the consent of a parent or legal guardian.

§3. User-Published Data

1. The User declares that they have the rights to the content posted in the Service and that it does not infringe the rights of third parties.
2. Weban is not responsible for content posted by Users.
3. In the event of a reported violation, Weban may remove data or block the User's Account.

§4. Prohibited Content

1. It is forbidden to publish content that is: vulgar, offensive, discriminatory, infringing copyrights, promoting violence, pornography, or hatred.
2. Weban has the right to delete accounts or data that violate these Terms.

§5. Liability and Limitation of Liability

1. Weban and the ProbeList.com Service make every effort to ensure data security and service continuity.
2. Weban is not liable for:
   • User actions leading to the loss or disclosure of data to unauthorized persons,
   • consequences of hacking attacks beyond Weban's control despite implementing appropriate security measures,
   • damages resulting from technical failures independent of Weban,
   • unauthorized access to the User's Account caused by the use of an inappropriate password or its disclosure.
3. The User agrees not to share their Account with third parties.

§6. Complaints

1. Complaints regarding the Service should be submitted electronically via the contact form.
2. Complaints will be processed within 14 business days.

§7. Changes to the Terms

1. Weban reserves the right to change these Terms with 14 days' notice.
2. Users will be informed of changes via email or a notification within the Service.

§8. Final Provisions

1. In matters not covered by these Terms, the provisions of Polish law shall apply.
2. Disputes related to the use of the Service shall be resolved by the court having jurisdiction over Weban's registered office.

§9. Technical Requirements

1. Use of the Service requires a device with Internet access and a web browser supporting JavaScript and cookies.
2. Some features may require cookies to be enabled for proper operation.

§10. Force Majeure

1. Weban is not liable for failure to perform or improper performance of obligations resulting from force majeure events, including: natural disasters, terrorist attacks, war, telecommunications infrastructure failures, pandemics, or other events beyond Weban's control.

1. For technical matters related to the Service, the User may contact us via the contact form available on the website or by email at: kontakt@probelist.com.

§12. Related Documents

1. The following documents form an integral part of these Terms:
   • Privacy Policy – defining the rules for processing personal data,
   • Subscription and Payment Terms – defining the conditions for using paid features of the Service.
2. In the event of discrepancies between the Polish language version and other language versions, the Polish version shall prevail.

§13. Account Deletion

1. The User has the right to delete their Account at any time using the function available in the user panel or by contacting the administrator at kontakt@probelist.com.
2. After account deletion, user data will be removed, except for data that the Administrator is required to retain under applicable law (e.g., tax regulations).

§14. Entry into Force

1. These Terms of Service enter into force on April 1, 2025.
2. The Terms apply to all Users from the date of publication on the Service.
3. In case of an update, the new version of the Terms shall take effect 14 days after publication, unless otherwise stated.
